Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while working from an unapproved work platform. (a) Bag Dept.: On or about 8/27/97, an employee was performing maintenance on a bag machine while standing on a hydraulic pump lift truck which is designed to be used for lifting material and not personnel. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide approved work platforms for employees to stand on, such as stairs or step ladders, when needed.
