Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to

at the side of the power screen. AMONG OTHER METHODS, ONE FEASIBLE AND
ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:
1) Instruct employees in the proper techniques of lifting unstable objects
as required by
CATERPILLAR OPERATION AND MAINTENANCE MANUAL for 335 Excavators, which
states "Use the lifting bar provided on the linkage to sling objects."
2) Follow the requirement of the CIMA SAFETY MANUAL FOR HYDRAULIC
EXCAVATORS, which states "Items to be lifted by a hydraulic excavator are
to be slung from
the manufacturer's designated lift point and not to drop elevated loads
from unnecessary
heights."
