General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards created by the tipping of the Barecat Self Propelled Elevating Work Platform. The safety drive height limit switch had been by-passed allowing employees to drive at heights between 15 and 21 feet above the floor in the plant and outdoors near the building and in the parking lots. The hazards of working outdoors from the platform are increased due to factors including but not limited to, wind, slope or grade of the pavement and depressions in the blacktop pavement. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to comply with the following: 1.) Manufacturer's Operating Manual and decals placarded on the machine stating: "Do not raise platform on uneven or soft surfaces. Do not drive onto uneven or soft surfaces when elevated. Do not raise platform on slope or drive onto slope when elevated. Do not raise platform in windy or gusty conditions. Warning, do not alter or disable limit switches, safety switches or interlocks." Perform manufacturer's required daily visual inspections and operational checks of control switches. 2.) ANSI/SIA A92.6-1990 Manual of Responsibilities for Self-Propelled Elevating Work Platforms which considers this Manual and the Operating Manual to be integral parts of the Aerial platform and must be kept on the Platform in the Storage compartment which states: a.) "Modification or alteration of an aerial platform shall be made only with prior written permission of the manufacturer." b.) " Altering Safety Devices. Altering or disabling of interlocks or other safety devices shall be prohibited." 3.) Train, document and enforce the above procedures.
