Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:in that; (a)Employee was standing above the highest allowable standing level on an eight (8) foot fiber glass step ladder, performing an assembly function on a trade fair display. The ANSI Standard A14.5-1992, Section 9.2.3. prohibits the user from standing on the top shelf or top step. This practice resulted in employee falling to the floor sustaining injuries which terminated in death on January 10, 1997. Event occurred on January 7 1997 at 2232 South 162nd Street, in New Berlin, Wisconsin. One feasible method of abatement is to train employees to use step ladders safely in conformance with the manufacturer's use instructions and ANSI A14.5-1992 specifications on "Safety Requirements For Portable Reinforced Plastic Ladders" or ensure the use of proper scaffolding which would be appropriate for the task being performed.e
