Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion and struck-by hazards: (a)Employee was performing a pneumatic leak test on a 55-gallon chemical storage container which exploded resulting in serious injuries on March 4, 1997. The contributing factors were evidenced by the following findings: (1) Applied pneumatic stresses on said vessel exceeded its design criteria; (2) the instruction sheet did not indicate how much maximum pneumatic pressure could be put in the tank; (3) compressed air regulator was relied upon instead of a safety relief device.
