Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)Employees were exposed to hazards created by the use of elevated work platforms which were not designed, constructed and/or used in accordance with the acceptable requirements of the American National Safety Standard for Rough Terrain Forklift Trucks, ASME/ANSI B56.6b-1998. The personnel platform did not meet the design requirements of that standard in that: (1) The work platform was not prominently marked with both the empty weight and maximum work load including personnel and equipment (see section f). (2) A restraining or securing means for personnel was not available (see section l). Among other methods, one feasible and acceptable means to correct these hazards is to assure that the design, manufacture and use of all attachments for Rough Terrain Forklift Trucks are in accordance with the most current American National Standard, B56.6 (presently B56.6b-1998), and/or obtain the prior approval of the lift truck manufacturer.
