Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)Employee was allowed to work near a rotating part with loose clothing
that
caused the employee to be caught by the rod and suffer serious injuries.
(b)Employee was allowed to add additional rods to the boring system while
not
being in visual or verbal contact with machine operator to prevent the
operator
from turning the machine on before the employee had time to get clear,
exposing
the employee to an entanglement hazard.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
Among others a feasible and useful method to correct this hazard is to
establish and
implement an effective communication system between exposed workers and
operators
to ensure workers are clear of danger areas when equipment starts.
