Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling (a) Hollywood Video Store, SWC of Veteran's Memorial Hwy. & Sunken Meadow Pkwy. - An employee was observed working approximately eleven and one-half feet in height, from the top step of a wooden six foot ladder, that was resting on the platform of an elevated scissor lift (MEC brand, model #2034HT, serial #8101597). The employee was not standing firmly on the work platform of the elevated lift; On or about 11/26/97. ABATEMENT NOTES: Among other methods, one feasible method to reduce this hazard is to: 1 (a) Train the operators to comply with the ANSI standard A92.6-1990, section 7.11.1, which states personnel shall maintain a firm footing on the platform floor while working thereon. Use of planks, ladders, or any other device on the aerial platform for achieving additional height of reach shall be prohibited. ABATEMENT VERIFICATION IS REQUIRED AS OUTLINED IN PART 29 CFR 1903.19D
