Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: The hazard of falling.
a)Jones Beach Marine Theater - An employee was observed standing
in the basket and driving a articulating boom truck in the nested
position, from one location to another on the job site.  The
employee was not wearing a safety belt/harness with lanyard.   On
or about 02/11/98.
ABATEMENT NOTES:
Among other methods, one feasible method to reduce the hazard is to:
1.Follow ANSI/SIA A92.5-1992 - Boom Supported Elevating Work Platforms,
Section 8.8 states:  "Ensure all personnel in the platform are wearing fall
protection devices and other safety gear as required at all times", and
2.Train the employees in the proper procedures while operating aerial
lifts,
such as, but not limited to, the wearing of a safety belt with lanyard.
ABATEMENT VERIFICATION IS NOT REQUIRED AS OUTLINED IN PART 29 CFR
1903.19
