Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: a)Distribution Warehouse Area -- Employees with the job title of forklift operator use the tynes of forklift trucks, or wooden pallets resting on the tynes of forklift trucks to elevate personnel daily without the use of fall protection to perform the following functions such as, but not limited to, daily inventory duties; on or about 5/19/98 through 8/10/98. ABATEMENT NOTES Among others, one suitable method for abating this hazardous condition is: 1.Utilize only platforms designed for use appropriate to elevating personnel with forklifts. These platforms must meet the requirements set forth in ANSI/ASME B56.1-1993 such as but not limited to, fall protection for employees. 2.Train all employees about the hazards of falls associated with improper elevating methods,and the proper application and use of safety platforms.n
