Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: (a) At the Jobsite/Southside Parking Lot - An employee was raised up 14 feet while standing in the front loading bucket of a John Deere Crawler Loader, Model # 455; he was directed to transfer diesel fuel oil from a commercial delivery truck into a 1000gal oil refueling tank mounted on a steel frame tubular scaffold, 2 frames 14ft high; On or about 5/22/98. ABATEMENT NOTES: Among other methods, one feasible method to reduce this hazard is to: (a) Follow Manufacturer's Operator's Manual Section on "Safety" wherein it states as follows: KEEP RIDERS OFF MACHINE Only allow the operator on the machine. Keep riders off. Riders on machine are subject to injury such as being struck by foreign objects and being thrown off of the machine. Riders also obstruc the operator's view resulting in the machine being operated in an unsafe manner. (b) Follow the guidance of the Equipment Manufacturers Institute's Safety Manual for Operators and Mechanics of Loaders/Tractors which states as follows: REMEMBER THE OTHER PERSON Never use a bucket for a work platform or personnel carrier. (c)Use a Commercial Refueling Service to maintain fuel in earthmoving and other off-road vehicles at the jobsite.
