Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
physical harm to employees in that employees were exposed to:

patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos
que esten causando o que puedan causar muerte o dano fisico a los
empleados, por cuanto empleados estaban expuestos a:
In the San Juan Termoelectric Central of the Electrical Energy
Authority in Puerto Nuevo - the exterior door of the elevator
Tornborgs, with capacity of 4,800 pounds and with serial number 210-
137-U-7 & 8, of the boiler # 8, where the employer removed the rubber
and the bushings that worked like a damping, created an aperture
aproximate of 3". Created that one boiler tube of 2 1/2" of wide X 12"
long and 1/4" thickness fell down through the aperture to 95 feet of
height, fell down in a roof, rebound to the first floor, and falling
them in the back cranium part of the employee.
Hazard: Strokes
Among other methods, one feasible and acceptable abatement method to
correct this hazard is the inspection for all the elevators in the
establisment to be in accordance with the ANSI/ASME A 10.4- 1990 for
Car Doors, Gates and Electrical Contacts, part 18.2.4.2 " Vertically
sliding counterweighted doors or gates shall be considered to be in
the closed position when the clear open space between the leading
edge of the door or gate and the sill of the car platform does not
exced 2 inches ( 5.8cm).

"Tornborgs, con capacidad de 4,800 libras y con numero de serie 210-
137-U-7 & 8, de la caldera # 8, donde el patrono removio la goma y los
cojines ("bushings") que trabajaban como amortiguadores, creando una
apertura de 3" aproximadamente. Creando que un tubo de caldera de 2
1/2" de ancho X 12" de largo y 1/4" de espesor cayera abajo por la
apertura a 95 pies de altura, cayendo a un techo, rebotando entonces
en el primer piso, y cayendo entonces en la parte trasera craneal del
empleado.
Riesgo:  Golpes
Entre otros metodos, un metodo aceptable y posible para corregir este
riesgo es la inspeccion  de todos los ascensores en el
establecimiento para estar en concordancia con el ANSI/ASME A 10.4 -
1990  para, Puertas de Carro, Entradas y Contactos Electricos, parte
18.2.4."Puertas que abren y cierran verticalmente y por contrapeso
seran consideradas cerradas cuando el espacio abierto entre el
borde de la puerta y la superficie del piso del carro no exceda dos
pulgadas (5.8cm).
