Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards related to rough terrain forklift truck operation: (a)Legacy Villas Apt., Near Building 200: A rough terrain forklift truck was used to lift people in a manner that violated industry standards in that a work platform, specially designed for use with this particular type of forklift truck, had not been securely attacked to the lifting carriage or forks. Among other methods, two feasible and acceptable abatement methods to correct this hazard are to: (1) Use a method to perform the work that does not involve elevating a person on a rough terrain forklift truck, and (2) Follow the practices for safe elevation of personnel on rough terrain forklift trucks detained in the industry standard, "Safety Standard for Rough Terrain Forklift Trucks," ASME/ANSI B56.6-1992.
