Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of falls into an open pit while operating aerial lifts in the area. (a) Job Site - Harris Cooper Store - The employer had not provided a safe area in and around the open pit to eliminate the potential hazard of employees having to operate aerial lifts in the area. Among other methods, one feasible and acceptable method is to install covers or guardrails around the open pit.
