Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by or being caught between rail cars or heavy equipment while positioning hopper rail cars: (a) Cement hopper rail car area - Front end loader used to position rail cars. "A feasible and acceptable means of abatement includes but is not limited to providing a rail car positioning device which allows employees to be remote from contact with the cars during positioning." ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
