Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to hazards created by oversized loads being placed
on material
handling equipment of smaller dimensions, and material handling equipment
which had not
been maintained in accordance with the manufacturer's recommendations.
a.)Veterans Administration Medical Center, Hampton, VA, Building 146,
Nursing Home and Extended Care Unit renovation project.  2002 International
4300 Diesel Panel Truck equipped with a 2500 lb. load capacity Anthony
Liftgate, Model AST-2500-SF.  On March 13, 2006, employee(s) were
exposed to hazards while unloading an oversized pallet of doors.  The
dimensions of the pallet exceeded the platform size of the hydraulic
liftgate;
and the liftgate had not been maintained in accordance with the
manufacturer's
recommendations as stated in the "Instruction and Operation Manual", where
it
is recommended the lift gate be adjusted as necessary to eliminate sloping
of
the platform due to normal wear of the gate.
A pallet of doors fell from the liftgate, which had a downward slope of two
inches, striking another company's employee who was standing on the ground
in front of the liftgate, resulting in fatal injuries to that employee.
ABATEMENT NOTE:
Among other methods, these feasible means of correcting noted hazards are:
1.Ensure the truck is equipped with an appropriately sized lifgate to
accommodate the size of the loads being placed on the platform.
2.Maintain the liftgate in accordance with the manufacturer's
recommendations to inspect the lift prior to using the lift, and ensure
the outer edge of the lift platform is 1/2" to 3/4" higher than the truck
platform.
3.Ensure all personnel have been restricted from standing in or moving
through the area where the lift is operating, or into the area where an
upset load might fall.
