Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to potential hoist failure:
(a)Building 4:  On or about February 11, 1998 and at times prior thereto,
the 1
ton underslung hoists were periodically lifting weights in excess of the
rated
load of the supporting beams, which was rated at 1/2 ton.  See Section 16-
3.2.1 of the American National Standards Institute Safety Code for Overhead
Hoists (Underhung)(ANSI B30.16-1987)
Among other methods, one feasible and acceptable abatement method to
correct this hazards
is:
1.Ensure employees do not lift loads in excess of the hoist's or the
supporting beams
rated capacity.
2.Have the supporting beams re-rated if feasible by a Registered
Professional Engineer.
