Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from possible overhead structure/hoist failure: (a)Mezzanine: On or about 29 April 1998, and at times prior thereto, the hook for the Budgit 2-ton electric chain hoist was not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, ASME B30.10a-1996, paragraphs 10-1.2.1.2 and 10-12.1.3 (b)Mezzanine: On or about 29 April 1998, and at times prior thereto, the Budgit 2-ton electric chain hoist was not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings, ASME B30.16b-1995, paragraphs 16-2.2.1.2 and 16-2.2.1.3. (c)Mezzanine: On or about 29 April 1998, and at times prior thereto, the overhead support structure for the Budgit 2-ton electric chain hoist was not inspected on a frequent and periodic basis in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Overhead and Gantry Cranes (Top Running Bridge, Single Girder, Underhung Hoist), ASME B30.17-1992, paragraphs 17-2.1.2 and 17-2.1.3. (d)Mezzanine: On or about 29 April 1998, and at times prior thereto, the supporting structure and the Budgit 2-ton electric chain hoist did not have a record documenting that an appropriate rated load test had been performed, in accordance with the America Society of Mechanical Engineers (ASME) Safety Standards for Overhead and Gantry Cranes (Top Running Bridge, Single Girder, Underhung Hoist), ASME B30.17-1992, paragraphs 17-2.2.2.
