Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards the were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion: (a)Production Building: On or about June 17, 1998 and at times prior thereto, the dust collection system for the combustible dust generated from processing the wheat straw, and the coconut fiber was not designed for explosion prevention, relief, and venting. (b)Production Building: On or about June 17, 1998 and at times prior thereto, the pneumatic conveying systems used to transfer the wheat straw, and the coconut fiber was not designed for explosion prevention, relief, and venting. The dust generated from this process is combustible. Among other methods, one acceptable means of abatement would be to comply with the requirements of National Fire Protection Association (NFPA) 61, Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Products Facilities(1995). Note: Abatement certification and supporting documentation are required for this item.
