Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that
employees were exposed to potential injuries from a vertical conveyor
hoist, such as, but not
limited to falls and crushing injuries:
(a)413 Main Street, Gooding, ID: On or about May 30, 1998, and at times
prior
thereto, employees would ride between floors a vertical reciprocating
conveyor
(1.5 ton material hoist) not intended to carry passengers.  The hoist did
not
meet the minimum requirements to comply with ANSI/ASME B20.1, Safety
Standard for Conveyors and Related Equipment.  See appropriate rules noted
below:
1.Rule 6.21.1(c): Personnel were not forbidden to ride the conveyor.
Warning signs to this effect were not prominently posted at each point
of access and each point of operation.
2.Rule 6.21.2(a): The conveyor was not guarded so as to prevent injury
from inadvertent physical contact.
3.Rule 6.21.2(b): The conveyor housing was not equipped with doors or
an equivalent device at each manual loading and unloading station,
interlocked so that they can be opened only when the carrier has
stopped at that level and the carrier cannot be moved until they are
closed.
4.Rule 6.21.2(e): Controls were not installed or located so they cannot be
actuated by a person on the carrier.
Among other methods, feasible and acceptable abatement methods to correct
this hazard
include:
1. Install above equipment, bring the hoist into compliance with ANSI/ASME
B20.1, and prohibit employees or other persons from riding the platform
between floors.
and/or
2.  Install and use an elevator designed for passengers in accordance with
American National Standard Safety code for Elevators, ANSI A17.1.
and/or
3.  Remove the hoist from service and install a stairway which meets all
applicable OSHA and building codes.
Note: This is not a conclusive list of deficiencies for this elevator.
Note: Abatement certification and supporting documentation are required
for this item.
