Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being thrown from a powered
industrial truck:
(a)Boise Supply Company yard:  On 25 November 1998, and at times prior
thereto, the employee operating the Toyota forklift, model #42-5FG25,
serial
#405FG25-40546, was observed not wearing his seat belt.
(b)Boise Supply Company yard:  On 25 November 1998, and at times prior
thereto, the employee operating the Caterpillar 90 forklift, model #DPL 40,
serial #3CM11254, was observed not wearing his seat belt.
