Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from a powered industrial truck: (a) Mixing area: On December 2, 1998 and at times prior thereto, employees operating the Clark forklift were not required to wear seat belts. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from possible overhead structure/hoist failure: (a) Van Dorn area: On or about December 2, 1998, and at times prior thereto, the pendant hoist did not have a load rate stenciled on the arch supporting the hoist in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cranes, Derricks, Hoists, Hooks, Jacks, and Slings (Overhead Hoists), ASME/ANSI B30.16-1973, paragraph 16-2.1.3.6. (b) Van Dorn area: On or about December 2, 1998, and at times prior thereto, the pendant hoist did not have a latch on the hook in accordance with the American Society of Mechanical Engineers (ASME) Safety Standards for Cranes, Derricks, Hoists, Hooks, Jacks, and Slings (Overhead Hoists), ASME/ANSI B30.126.1.1.2.10(d). Note: Abatement certification and supporting documentation are required for this item.
