Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to work from elevated work platforms that were not on level surfaces: (a) Chapel - On or about January 7, 1999 and at times prior thereto, the Skijack SJII 4626 scissor lift was not being operated in accordance with the manufacturers operating instructions in that it was parked on a ramp with a grade of approximately 7.1 to 8.6 percent while employees on it's elevated platform masked, painted and removed the masking along the top of the wall. The distance from the floor to the ceiling in this area is approximately 30 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require and enforce the use of scaffolding with adjustable jacks. Note: Abatement certification required for this item.
