Section 5(a)(1) The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing, or were likely to cause death or serious physical harm to employees in that an employee was exposed to the hazard of falling approximately 32.5 feet to the ground below: On the East side of the office building, an employee constructing a parapet wall from a platform lifted by a Sky Trak rough terrain forklift, Model #8042, was unprotected from falls while standing on the midrail of the guardrail system. Among other methods, one feasible and acceptable abatement to correct this hazard is to utilize a personnel platform in conformance with the following sections of ASME B56.5-1992, American National Standard for Rough Terrain Forklift Trucks: PART IIFor the User 5.15.1If a rough terrain forklift truck must be used to lift people, the following precautions for the protection of personnel shall be taken: (a) Provide a personnel platform which complies with design requirements listed in Part III of this Standard. (k) Be certain that required restraining means such as railings, chains, cable, body belts and lanyards, etc., are in place and properly used. (u) Personnel are to maintain firm footing on platform floor unless secured by body belt and lanyard. Use of railings, planks, ladders, etc., on the platform for the purpose of achieving additional reach is prohibited. PART IIIFor the Manufacturer 8.25.1Design requirements for the manufacture of the platform shall include the following: (f) information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform.
