Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Up to and including 6-12-97, the lift gate for truck #126 was not maintained in safe operating condition in that the lift gate would not close completely, thus exposing employees to the hazard of having to use excessive force to close the lift gate manually. "Among other methods, one feasible and acceptable abatement method to correct this hazard would be to replace the rear roller on the passenger side of the lift gate so that it would close completely."
