Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Forklift operators were not required to wear existing seat belts for either of the (2) Clark forklifts, serial numbers GX127E-632-9345KOF and TN247-0134-8120FB, used throughout the facility, thus exposing operators to the hazard of having the forklifts fall on them should a tipover occur. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of seat belts at all times."
