Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of entrapment of the operator's head and/or torso between the truck and ground in the event of a tipover: Employees operating the Toyota lift trucks were not required to wear seat belts provided with the lift trucks to prevent them from being thrown from the truck as required by ASME/ANSI B56.1-1995, Safety Standards for Low Lift and High Lift Trucks, Section 5.3.19. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS REQUIRE THE OPERATORS OF THE LIFT TRUCKS TO WEAR THE OPERATOR RESTRAINT SYSTEM"NT
