General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by a falling beam, which is being held in position for touch up painting by the stacker machine when the power to the machine is interrupted. On or about July 8, 1998, the nitrogen accumulators for the stacker machine located in building 150 of department 70 was not being maintained in a charged condition, thus allowing a beam to fall when the power was interrupted. Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement a preventative maintenance program, including but not limited to, maintaining the pressure in the nitrogen accumulators as well as maintaining other integral components of the machine(s).
