Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees working in the landfill were exposed to the hazard of injury
from motor vehicle
accidents which back-up alarms or spotters are designed to address:
On or about October 5, 1998, on the north side of the silt dam employees
were exposed to
the hazard of being struck by a Ford F-150 pick-up truck due to the fact
that motor vehicle
operators were not required to keep a clear view of the path of their
travel while backing up
with the truck bed loaded such that the driver was unable to see in the
direction of travel.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to require the driver of the vehicle to keep a clear view of the path
of travel, install a
back-up alarm on the vehicle loud enough to be heard above surrounding
noise or to assign a
spotter to watch the operation of backing up with the truck bed loaded
such that the driver is
unable to see in the direction of travel.
