Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees at Keystone Steel and Wire are exposed to the hazard of being struck by the Locomotive and rail cars while using the Rod Mill Gate Crossing. Employees utilize the crossing to transport material, transport equipment, and to access work areas. Among other methods, feasible and effective means of controlling the hazard is to provide adequate warning devices on the train and to ensure that traffic stops at a safe distance from the crossing.
