Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On 9/24/98 an employee was exposed to hazards while allowing an extensible boom forklift to assist in elevating a scissor lift at UniMed Hospital in Minot, North Dakota. One feasible means of abatement, among others, would be for the employer to develop and implement a written, comprehensive training program that would include training employees in the safe operation, inspection, and application consistent with all the available data regarding the parameters of intended use and in conformance with good safety practices, as required by ANSI A92.6-1990, Rule 7.1. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion
