Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) At 805 Fifth Street, Belle Fourche, SD, where a positive means of fall protection was not provided for employees required to work on top of rail cars during grain loading operations and exposed to a potential fall hazard of approximately 15 feet. Among other methods, one feasible and acceptable abatement method to eliminate this hazard would be to install a fall protection system that would accommodate safety harnesses and lanyards. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) For employees riding the manually operated manlift and exposed to a potential fall hazard of approximately 25 feet created by the lack of a car enclosure on the manlift. (b) For employees working near the manually operated manlift and potentially exposed to a struck-by/crushed-by hazard due to the lack of a complete standard railing system around the base of the manlift. Among other methods, a feasible and acceptable abatement method to eliminate these hazards would be to install railings with a gate or chains on the manlift platform and also around the area of the base of the manlift.
