Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Powder Paint Booth, cleaner was exposed to levels of 1,3,5-Triglycidyl Isocyanurate in excess of the manufacturer and ACGIH recommended time-weighted average (TWA) of 0.05 mg/M3 during employee's eight-hour work shift on November 5, 1999. Cleaner was exposed to 31.0 mg/M3 of 1,3,5-Triglycidyl Isocyanurate during the 57 minute sampling period, zero exposure was assumed for the remaining 403 minutes. This is approximately 74 times the allowable recommendations. Among other methods, one means of feasible and acceptable abatement method to correct this hazard is to utilize a vacuum system to collect powder paint residue.
