Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) In Building 40 of the Bismarck Bobcat facility, an employee was
exposed to a
potential crushing hazard while operating the scissor lift when the moving
conveyor
system contacted and subsequently caused the tipping of the scissor lift.
Abatement Note:  Feasible methods of abatement, among others, would be:
1. To rope off or barricade and post caution signs around the perimeter of
where the scissor lift
was stationed, as stated by the proposed conveyor OSHA standard of 1974,
29 CFR
1910.186(f)(2)(i).
2. To remove all maintenance equipment and conduct a visual inspection of
the conveyor and
immediate area before activating the conveyor as stated by the proposed
conveyor OSHA
standard of 1974, 29 CFR 1910.186(f)(4).
3. To lock out the starting device or at least to monitor the starting
device so that no one will
inadvertently restart conveyor with employee potentially exposed to
hazard, as stated by ANSI
B20.1-1972, Rule 5.26.2.
