Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) At Bay #1, the automotive hoist was operated with the safety leg removed from the hoist, exposing employees to struck-by or crushing injuries. Among other methods, one feasible and acceptable method of abatement would be to repair the hoist to ensure that the safety devices are in working order as required by ANSI B153.1-1990, Rule 4.1.11.
