Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) For employees working on top of rail cars during loading operations at the #1 elevator. (b) For employees working on top of rail cars during loading operations at the #2 elevator. (c) For employees working on top of rail cars during loading operations at the #3 elevator. Among other methods, one feasible and acceptable means of abatement would be to install some type of acceptable fall protection device. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion
