Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by or crushed by falling objects associated with collapse or failure of steel storage racks: (a) In the freezer areas, the steel storage racks used for storing products had bent, damaged or broken parts and/or components including braces, vertical support legs, and storage platforms. (b) Throughout the warehouse, the steel storage racks had bent, damaged, or bowed parts and/or components including braces, vertical support legs, and storage platforms. This is an industry recognized hazard and is identified in the American National Standards Institute (ANSI) MH16.2-1984 Section 1 Paragraph 1.3. Among other methods, one feasible and acceptable means of abatement would be to follow the guidelines established in ANSI MH16.2 which states that damaged racks shall be immediately unloaded and the damaged portions be repaired or replaced.
