Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing or falling when trailers were moved away from the loading dock while dock workers were engaged in loading or unloading material: (a) On or about 07/11/06 at Drayton Enterprises, L.L.C., 1307 39th Street North, Fargo, ND, an employee suffered a partial amputation injury of two toes while attempting to dismount a forklift that was falling from the loading dock into the loading dock pit after the semi-tractor/trailer was inadvertently moved away from the loading dock. (b) On or about 09/22/06 at Drayton Enterprises, L.L.C., 1307 39th Street North, Fargo, ND, an employee was exposed to the potential for serious injury and/or crushing hazard while attempting to dismount a forklift that was falling from the loading dock into the loading dock pit after the semi-tractor/trailer was inadvertently moved away from the loading dock. Among other methods, feasible and acceptable abatement methods to correct this hazard is to: 1. Implement a written procedure for the loading and unloading of trucks that places the control of the truck under the guidance of one person. That person will communicate with the truck driver and forklift operator throughout the entire loading and unloading procedure to ensure that material to be loaded or unloaded is accomplished safely and also ensure that the forklift operator is at a safe distance from the back of the trailer and loading dock when the trailer is moved away from the loading dock. 2. Install a stop/go light system at all dock doors that will display a red light that signifies to the truck driver and warehouse workers that a truck is being loaded or unloaded and that the trailer must not be moved from the loading dock. After completion of the loading or unloading and the forklift operators are a safe distance from the back of the trailer and the loading dock, the light will be switched to green signifying that it is safe to move the trailer away from the loading dock. 3. Install dock locks at all loading docks to be attached to the back of trailers to ensure that a trailer can not be moved away from the loading dock while forklift operators are loading or unloading trailers.
