Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Being struck by the load should the overhead hoist, monorail structure or
below-the-hook lifting
device fail;
(a) In the truss plant, three CM Lodestar electric chain hoists used to
lift wooden trusses
weighing up to 1500 pounds. These hoists were suspended from monorails
which carried
no labeling of the load rating, it was unknown what load the building
structure would
carry thus posing a crushing hazard to employees if it were to fail.
(b) In the truss plant, three CM Lodestar electric chain hoists, no
complete
program of frequent or periodic inspections had been implemented, the only
documented inspections were daily checks of the brakes and the load chain.
These
inspections began October 4, 1997.
(c) In the truss plant, on or about November 24, 1997, building MM 3,
press 3,
CM Lodestar electric chain hoist was used with a unmarked, unrated and
uninspected below-the-hook lifting device to lift wooden trusses weighing
approximately 1500 pounds for which the device was not designed. This
condition
exposed employees to the hazard of crushing if the device was to fail or
the load
were to otherwise disengage itself from the device.
Among other methods, feasible and acceptable methods to correct these
hazards are:
(a) Determine the load rating of the supporting structure, ensuring that
it is at
least equal to that of the hoists, or provide a structure with such a
rating, as per
ANSI B30-16-1.3.2
(b) Perform frequent inspections at daily to monthly intervals and periodic
inspections at monthly to yearly intervals as per ANSI B30-16-2.1.1,
2.1.2, 2.1.3
or the owners manual. Written, dated and signed inspection reports should
be
maintained at time intervals specified in ANSI B30-16-2.1.1(b)(2).
(c) Insure that below-the-hook lifting devices are designed and used for
the object
they are lifting, ensure that they are properly marked and rated for the
loads
imposed. Perform frequent inspections at daily to monthly intervals and
periodic
inspections at monthly to yearly intervals per ANSI B 30-20-1.2.1, 1.3.1
and
1.6.4. Records of periodic inspections shall be maintained, or the device
marked
to indicate the inspection was performed per ANSI B30-16-20-1.3(b)(2).
