Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling from and being run over by moving construction equipment. (a) On August 21, 2001 and employee was observed riding on the step of a John Deere 544 D front-end loader, #411. Among other methods, one feasible and acceptable means to correct this hazard would be to develop and enforce a work rules prohibiting riders on equipment that does not have an place for a rider designated by the manufacturer of the equipment which is addressed in the Society of Automotive Engineers Standard SAE J153 May 87, "Operator Precautions", section 4.3.ion
