Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the point of operation on the press brake: (a) In the center shop area; Roto-Die press brake, Model 15, SN 80037 used to bend and shape, point of operation is not guarded and a foot pedal is used to initiate the stroke. Among other methods, one feasible and acceptable abatement method to correct the hazard is to: Implement an effective "Safe Distance" Safeguarding Program as described in ANSI B11.3-1982, Safety Requirements for Construction, Care, and Use of Power Press Brakes. Elements of the program include: (a) Exposure prevention procedures (b) Training (c) Retraining (d) Supervision (e) Periodic inspections
