Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm in that employees were exposed to serious injury or death from an inadequately guarded platform mounted on a rough terrain forklift. (a) At the site, two employees were exposed to serious injury or death created by the use of an elevated work platform which was not designed, constructed, and/or used in accordance with the acceptable requirements of the American National Safety Standards for Rough Terrain Forklifts, ASME/ANSI B56.6a-1994 and other acceptable industry practices. In this case, the platform did not meet the following design requirement of sections 8.25 and 5.15 of ASME/ANSI B56.6a in the following areas: (1) The platform did not have a front guardrail at a height of 42 inches and/or safety harnesses and lanyards used. (2) The platform did not have the maximum working load capacity prominently marked on the platform. The above conditions were observed when two employees were exposed to a fall hazard of approximately 14 feet while standing on a platform attached to a rough terrain forklift. Among other methods, feasible and acceptable methods to correct these hazards are to utilize a scaffold or use a platform approved by the manufacturer meeting the design, manufacturing, and requirements of ASME/ANSI B56.6a for all attachments on rough terrain forklifts.
