Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls and/or being struck by falling trusses: (a)Midwest Manufacturing board plant, Building 18, Eau Claire, WI., On or about July 16, 2002, employees were exposed to the hazard of being struck and crushed by inadequately braced and secured wood trusses. In this case, the employer did not follow the recommendations of the Truss Plate Institute HIB-91 Summary Sheet Commentary and Recommendations for Handling, Installing & Bracing Metal Plate Connected Wood Trusses, in the following areas: (1) The trusses, which measured 88 feet 8 inches in length, were sporadically braced to each other between the top and bottom chords and webbing. (2) As the trusses were being set in place, the crane was releasing them before the ends were securely fastened in place. (3) For trusses over 60 feet in span length, a registered professional engineer was not consulted prior to the commencement of truss erection. Note: In the construction prints provided by the manufacturer, it states under the precautionary notes that "All bracing and erection recommendations are to be followed in accordance with, "Handling Installing & Bracing, HIB-91." Among other methods, feasible and acceptable methods to correct these hazards would be to install trusses in accordance with the Truss Plates Institutes recommendations which are contained in HIB-91, Commentary and recommendations for Handling, Installing & Bracing Metal Plate Connected Wood Trusses.
