Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in an employee was exposed to a fall hazard when standing on the top cap of a stepladder. (a)Taco Johns, 1526 N. Broadway, Menomonie, WI; employee was exposed to a fall hazard of approximately 10 feet while standing on the top cap of a 10 foot fiberglass stepladder while painting a sign. Among other methods, one feasible and acceptable method of abatement to correct this hazard would be to develop a safety work rule against this practice and training workers in the conformance with the manufacturers "use" instructions.
