Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to serious injuries or death when utilizing a platform
attached to a rough terrain
forklift which was not provided with front guardrails, and was oversized.
(a)At the site, two employees were exposed to serious injury or death
created by the
use of an elevated work platform which was not designed, constructed,
and/or
used in accordance with the acceptable requirements of the American
National
Safety Standards for Rough Terrain Forklifts, ASME/ANSI B56.6b-1998 and
other acceptable industry practices.  In this case, the platform did not
meet the
following design requirements of sections 5.15 and 8.25 of ASME/ANSI B56.6b
in the following areas:
(1)  The platform did not have a front guardrail at a height of 42 inches
and/or
safety harnesses and lanyards used.
(2)  The platform dimension exceeded in width more than 10 inches greater
than
the overall width of the truck on either side.
(3)  The platform was not prominently marked with the empty weight
information.
The above conditions were observed when two employees were exposed to a
fall
hazard of approximately 18 feet while standing on a platform attached to a
rough
terrain forklift.
Among other methods, feasible and acceptable methods to correct these
hazards
are to utilize a scaffold, aerial lift, or platform approved by the
manufacturer
meeting the design, manufacturing, and requirements of ASME/ANSI B56.6b for
all attachments on rough terrain forklifts.
