Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Production Area - Bushel Handling machine was actuated by foot pedal. Foot pedal was not guarded against accidental contact. Guard shall cover top and both sides against contact. b)Production Area - Bostitch Box Stapler machine was actuated by foot treadle. Foot treadle was not guarded against accidental contact. Guard shall cover entire treadle against contact. OR IN THE ALTERNATIVE: 29 CFR 1910.212(a)(1): Machine guardingwas not provided to protect operator(s) and other employees from hazard(s) created by unguarded foot pedals or foot treadles: a)Production Area - Bushel Handling machine was actuated by foot pedal. Foot pedal was not guarded against accidental contact. Guard shall cover top and both sides against contact. b)Production Area - Bostitch Box Stapler machine was actuated by foot treadle. Foot treadle was not guarded against accidental contact. Guard shall cover entire treadle against contact.
