Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees in the bag cleaning room (operations - main floor) were
exposed to burns, smoke inhalation, and concussion injuries
resulting from fire and explosion due to the presence of the
following conditions:
a. Existence of significant quantities of dust that ranged in
settled depth from approximately one-eighth inch to three and
one-half inches on horizontal surfaces throughout this area.
b. Analysis of the dust indicated that the dust was explosive:
Kst range from 8.9 to 16.8 bar meters / second; note that as
a reference, pulverized Pittsburgh coal (an explosive dust)
has Kst values that range between 15 and 35 bar meters /
second.
c. Open flame sources of ignition from two operating kerosine
space heaters:
(1) Reddy heater
(2) Ker-o-sun style heater
NOTE:  Among other methods, an acceptable method of abatement
includes the development and implementation of a more efficient
dust collection system (engineering control) to capture and contain
the dust that is generated/released during the cleaning of
polypropylene tote bags; an acceptable interim control is to
perform regular vacuuming of the area to eliminate the accumulation
of explosive dust on horizontal surfaces throughout the area.ghout
