General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious hazards of being struck by the train and the release of chlorine from the train hitting a chlorine car being loaded. Chlorine Loading Area- On or about November 11, 1997 the General Electric Diesel Electric locomotive that was moving 5 loaded tank cars and 1 empty caustic soda car onto the scale track had one of the brake cylinders removed and out for repair. Because the locomotive only had part of it's braking capacity, it could not stop the train and ran into the car being loaded with chlorine and a chlorine spill resulted. Among other methods, one feasible and useful abatement method is to ensure that all locomotives used to move loaded and empty tank cars are equipped with all necessary equipment to enable the locomotive to stop the cars when required.e
