Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burns and smoke inhalation from fires and explosions due to an inadequate employee emergency and fire prevention plan: In the following instances the fire prevention plan was inadequate: a)30's Complex - A person was not designated to account for all employees after an emergency or fire. b)Throughout the Facility - New employees were not trained in the steps or procedures to be taken in the event of a fire or emergency. c)Throughout the Facility - Employees were trained to meet inside of the egg packing plants in the event of a fire. d)80's Complex - A system was not in place to warn barn employees in the event of a fire in the egg packing plant. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop an employee emergency and fire prevention plan. An effective employee emergency and fire prevention plan includes the following elements but is not limited to: 1)Emergency escape procedures and emergency escape route assignments to include secondary escape routes. The procedures shall designate a safe meeting place for employees to gather. 2)Procedures to be followed by employees who remain to run or shut-down critical plant operations. 3)Procedures to account for all employees after emergency evacuation has been completed. 4)Rescue and medical duties for those employees who are to perform them. 5)The preferred means of reporting fires and other emergencies. 6)Names or regular job titles of persons or departments who can be contacted for further information about the plan.

Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide material safety data sheets in Spanish.
