Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Southeast side of marine terminal;  On March 6, 2000, an intermodal
container toploader got
stuck in a depression/hole along the southeast side of the terminal and
adjacent to a railroad car.
A mobile truck crane and a toploader were used to extract the stuck
toploader.  A wire rope
sling was stretched between the two toploaders.  No steps had been taken
to prevent other
employees or vehicles from entering the area where this operation was
taking place, thereby
exposing an employee to fatal injuries when a vehicle was driven into the
area and struck the
wire rope.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to barricade the area around the operation and provide signs or signals to
prevent entry into the
area.
